Guest Use Agreement & Comprehensive Liability Waiver Applies to All Guests, All Amenities, and All Property Conditions Includes Community Pool, Hot Tub, Beach Access & Environmental Risks By booking this property, you and all members of your party acknowledge and accept the following terms. This agreement is binding upon all guests associated with the reservation. 1. COMMUNITY POOL & HOT TUB – USE AT YOUR OWN RISK The pool and hot tub are community amenities maintained by the property’s homeowners association (HOA). They are unsupervised and used entirely at your own risk. All guests must comply with posted HOA rules including hours, maximum occupancy, safety policies, and behavior standards. Temporary closures may occur without refund due to weather, maintenance, or public health guidance. 2. WATERBORNE ILLNESS & LEGIONNAIRES’ DISEASE NOTICE Legionella bacteria, which can cause Legionnaires’ disease (a potentially serious form of pneumonia), may exist in water systems, including but not limited to: Pools or hot tubs Showers, faucets, sinks Cooling systems or HVAC units Sprinklers, decorative fountains, or other plumbing fixtures While the host and HOA adhere to industry-standard maintenance practices, no system is guaranteed to be free of Legionella or other waterborne pathogens. By staying at this property and using any water system, you acknowledge and accept: The inherent risk of exposure to Legionella and other environmental bacteria That guests who are immunocompromised, elderly, smokers, or have chronic respiratory or kidney conditions may be at higher risk That you voluntarily assume all risks related to such exposure and waive liability to the maximum extent permitted by Maryland law 3. GENERAL SAFETY RULES – POOL, HOT TUB & BEACH No lifeguard is on duty. Children must be supervised at all times. No diving, running, or glass containers allowed near the pool or hot tub. Use of alcohol or drugs while using these amenities is prohibited. Limit hot tub use to 15 minutes. Consult a doctor before using the hot tub if pregnant, elderly, or suffering from heart, blood pressure, or respiratory conditions. 4. BEACH ACCESS & OCEAN HAZARD NOTICE The property provides access to a public or semi-private beach. There are no lifeguards. Swim at your own risk. Ocean hazards include: Riptides and strong currents (which can be fatal even for strong swimmers) Sharks, jellyfish, and other marine wildlife Floating debris, rough surf, and changing weather conditions Guests are responsible for supervising minors and ensuring safe behavior at the beach. Do not swim alone, and avoid swimming at dawn/dusk or after storms. 5. PROPERTY CONDITIONS & ENVIRONMENTAL RISKS The property may include stairs, walkways, decks, uneven terrain, insects, wildlife, and other natural features. Guests should use caution outdoors, especially at night or after rainfall. The host is not responsible for injury or illness related to natural hazards, allergic reactions, slips, or animal encounters. 6. RELEASE OF LIABILITY & INDEMNIFICATION To the maximum extent permitted by Maryland law, you and your guests agree to: Waive, release, and discharge the host, property owner, manager, and affiliates from any and all liability or claims for: Injury, illness (including Legionnaires’ disease), or death Property damage or loss Emotional distress Exposure to natural, biological, or environmental hazards This includes incidents arising from: Use of the pool, hot tub, or beach Water or HVAC systems on or near the property Acts of nature, third parties, or HOA-controlled spaces This waiver covers ordinary negligence but not gross negligence or intentional misconduct, which cannot be waived under Maryland law. You further agree to indemnify and hold harmless the host for any damages, legal claims, or expenses arising from your own or your guests’ misuse of the property, failure to follow rules, or violation of community policies. 7. ACKNOWLEDGMENT By booking this property, you confirm that: You are 18 or older and legally authorized to accept these terms for your entire party. You have read and understood this agreement in full. Our quick weekend stay was everything we hoped for. We booked at the last minute and everything went so well. The condo is beautiful and well decorated. The view is beyond perfect. We were able to watch the sunrise each morning from bed. The view is wide open from the large bedroom window straight through to the balcony. Absolutely gorgeous. Between the view and the bed, I slept the best I have in a while. The owners were very responsive to any small issue we had. The door code didn’t work for us the first time but they were so quick to fix. We struggled with the tv once, but that was user error. They were great. We would absolutely stay again and I look forward to it.

My family really enjoyed staying here. The unit was clean, had everything we needed and was exactly as expected based on the photos. It was so nice to have the balcony and sliding glass doors so we could wake up to the sounds and view of the ocean and enjoy watching the sunrise, sunset, and beautiful harvest moon!

We were excited for the "5star" luxury experience as advertised by Elysian. Unfortunately, the condo does not meet this claim. It is updated and the view is beautiful, but that's about it. It was "cleaned" but dirty. There were coffee grains and garbage in the drawer that housed the cans. Sand embedded in rugs and corners. We found a rotting orange under the bed, Qtips, and food in the pullout couch. The extra pillows and blankets were on the floor of the closets; the ironing board laying on top of them. The shower door in the master leaked soaking the mat every shower. The towels were minimal. The hosts offered to drop a few more but never did. Pillows were flat. No full length mirrors, few hooks. The wifi signal was terrible until I complained and was told there were two signals for the unit and given a new code. The kitchen is minimally equipped. Cabinets/drawers were messy and scattered. This is an overpriced rental-mill company with little intention put into guest satisfaction.

We would love to stay here again. I had my 80 year old parents and two small children. The walk out to the beach was doable for all. There was not a lot of lobby or hallway walking which really helped. Not a wait for elevators. It was great. The view was beautiful. The inside was modern and very nice. This is the best place I have stayed in OC. The pool area was eh but that can’t be helped by the owners. The pool itself was clean enough just the deck and inside was kind of gross. The host was very quick to respond. One of the nicest things was that they said don’t clean up enjoy your vacation! I didn’t realize how nice that was until I had extra at the beach my last morning instead of stripping beds! The shower was amazing!!!!! Multiple shower heads. They also had soap and tp and dishes etc. so if you forgot something they probably had it.
